Cancellation & Refund Policy

Summary.

Sivient is a subscription service billed in advance. You can cancel at any time and will keep access until the end of the period you have already paid for. We do not, as a general rule, refund fees for partial billing periods, but we always honour the refund rights granted to you by applicable law and the specific situations set out below — including duplicate charges, unauthorised debits, and billing errors. This policy forms part of, and should be read with, our Terms of Use and Privacy Policy.

1. Scope and Definitions

This Cancellation & Refund Policy ("Policy") governs the cancellation of subscriptions and the issuance of refunds for the Sivient AI-powered email, calendar, and meeting management assistant (the "Platform" or "Services"), operated by Sivient Technologies Private Limited, a company incorporated under the laws of India with its registered office in Bengaluru, Karnataka ("Sivient", "we", "us", or "our"). Capitalised terms not defined here have the meaning given in our Terms of Use.

2. Subscriptions and Billing Cycle

Subscription fees are charged in advance on a recurring monthly or annual basis, depending on the Subscription Plan you select. All fees are exclusive of applicable taxes, including Indian Goods and Services Tax (GST), which is charged at the prevailing statutory rates. By starting a paid subscription you authorise Sivient and its payment processors to charge the applicable fee to your selected payment method at the beginning of each billing cycle until you cancel.

3. Free Trials and Free Plans

  • Where we offer a free trial, you will not be charged during the trial period. Unless you cancel before the trial ends, your subscription automatically converts to a paid plan and the first billing charge is applied.
  • Free plans carry no charge and therefore no refund applies to them.
  • We will send a reminder before a trial converts wherever practicable, but you are responsible for cancelling before the trial ends if you do not wish to be billed.

4. How to Cancel

You may cancel your subscription at any time by either:

  • Using the in-app billing settings of your workspace (Settings → Billing → Cancel subscription); or
  • Emailing us at admin@sivient.com from the email address associated with your account.

Cancellation takes effect at the end of your current billing period. You retain full access to the Services until that date, and your subscription will not auto-renew for the following period. Cancelling does not, by itself, trigger a refund of fees already paid for the current period, except as described in Sections 5 and 6.

5. General Refund Position

Because access is provided immediately and continuously throughout each billing cycle, fees already paid for the current period are generally non-refundable, and we do not provide pro-rata refunds for unused time after a cancellation or downgrade — except where a refund is required by applicable law or expressly granted under this Policy or our Terms of Use.

Nothing in this Policy limits any non-waivable statutory rights you may have as a consumer under the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, or other applicable law.

6. When We Do Issue Refunds

We will review and, where appropriate, issue a full or partial refund in the following circumstances:

  • Duplicate or erroneous charges. If you were charged more than once for the same billing cycle, or charged in error, we refund the excess amount in full.
  • Unauthorised transactions. If a charge was made without your authorisation, notify us promptly and we will investigate and, on confirmation, refund the unauthorised amount.
  • Failed activation. If you paid for a subscription but, due to a verified fault on our side, were never able to access the corresponding paid features, we refund the charge in full.
  • Material, unresolved service failure. If the Platform is materially unavailable or non-functional for a sustained period due to a fault attributable to Sivient, and we are unable to resolve it within a reasonable time after you report it, we may issue a pro-rata refund for the affected period.
  • Termination for our breach. If we terminate or are required to cease providing the Services in the circumstances described in Section 7.1 of our Terms of Use (IP indemnity), we provide a pro-rata refund of any pre-paid, unused subscription fees.

7. RBI E-Mandate Cancellation (Cards & UPI AutoPay)

For subscriptions billed using Indian debit cards, credit cards, or UPI AutoPay under the Reserve Bank of India's e-mandate framework, you may revoke the recurring mandate at any time:

  • Through the secure cancellation link included in the 24-hour pre-debit notification sent before each recurring debit;
  • Through your bank's or card issuer's standing-instruction management interface; or
  • By cancelling your subscription in-app or by contacting us, after which no further recurring debit will be initiated.

Revoking a mandate stops future debits. It does not automatically refund a charge already collected for the current period; any refund of an already-collected amount is governed by Sections 5 and 6.

8. How Refunds Are Processed

  • Method. Approved refunds are credited to the original payment method used for the transaction. We do not issue cash refunds or transfers to a different account or instrument.
  • Timeline. Once approved, refunds are initiated within five (5) to seven (7) business days. The time for the amount to appear in your account thereafter depends on your bank, card network, or payment provider and is outside our control.
  • Taxes. Any GST or other taxes collected on a refunded amount are adjusted or refunded in accordance with applicable tax law.
  • Currency. Refunds are issued in the original currency of the transaction; we are not responsible for foreign exchange differences applied by your bank or card network.

9. Requesting a Refund

To request a refund, email admin@sivient.com from the email address associated with your account, including your workspace name, the transaction reference or mandate ID, the date and amount of the charge, and a brief description of the reason. We aim to acknowledge refund requests within three (3) business days and to communicate a decision within a reasonable time after receiving the information needed to assess the request.

10. Chargebacks

If you believe a charge is incorrect, please contact us first so we can resolve it quickly. Initiating a chargeback or payment dispute without first contacting us may result in temporary suspension of your account pending resolution. Where a chargeback is later found to be unwarranted, we reserve the right to reinstate the corresponding charge and recover associated dispute fees.

11. Changes to This Policy

We may update this Policy from time to time. Material changes will be notified via email or through the Platform, and the "Last updated" date above will be revised. Refund requests are assessed under the version of this Policy in effect at the time of the relevant charge.
